These Terms of Service (“Terms”) govern your use of the hosting services (“Services”) provided by PressTitan (“Company,” “we,” “us,” or “our”). By purchasing, accessing, or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.
1. Eligibility
You must be at least 18 years of age or the legal age of majority in your jurisdiction to use our Services. By using our Services, you represent and warrant that you meet this requirement.
2. Services Provided
PressTitan offers managed WordPress hosting, website optimization, premium plugin and theme access, and related support services. These services are provided “as-is” and may change or evolve over time. Specific service details are described on our website and support documentation.
3. Account Registration
You must provide accurate, complete, and current information when registering for an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
4. Acceptable Use Policy
You agree not to use our Services for any unlawful, abusive, or harmful activities. Prohibited actions include (but are not limited to):
- Hosting or distributing malware, viruses, or malicious code
- Sending spam or unsolicited communications
- Infringing on the intellectual property rights of others
- Hosting adult content or prohibited materials
- Launching denial of service (DoS) attacks
- Engaging in illegal or fraudulent activity
Violation of this policy may result in suspension or termination of your account without notice.
5. Payment & Billing
All services are billed in advance on a recurring basis (monthly or annually). By purchasing a plan, you authorize us to charge the payment method on file for the applicable fees. All payments are non-refundable, except where required by law or stated otherwise in writing.
6. Cancellations & Terminations
You may cancel your service at any time via your account dashboard or support ticket. Upon cancellation, your access to Services will continue until the end of your current billing period. We reserve the right to suspend or terminate accounts for violations of these Terms, non-payment, or abuse of services.
7. Backups and Data Responsibility
We perform regular automated backups as part of our hosting services; however, we do not guarantee the availability, accuracy, or integrity of those backups. You are solely responsible for maintaining up-to-date copies of your website and content. We recommend independent backups for critical data.
8. Resource Usage Limits
Each hosting plan includes allocated resources (e.g., storage, bandwidth, CPU). Excessive use of system resources that degrades service performance for others may result in throttling, upgrade requests, or suspension.
9. Premium Tools & Licensing
Access to licensed premium plugins and themes (e.g., WP Rocket, ACF Pro, Focus Theme) is provided only while your account is active and in good standing. These licenses are valid only within the PressTitan hosting environment and may not be transferred or used on external servers.
10. Support Services
Support is available to active customers through our Support Portal. We do not guarantee a specific resolution time but aim to address issues within 24 business hours. Our support covers hosting-related issues only and does not include custom development, third-party plugin support, or design work.
11. Limitation of Liability
To the maximum extent permitted by law, PressTitan shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, data, or business opportunities, resulting from the use or inability to use our Services.
12. Disclaimer of Warranties
Our Services are provided “as-is” and “as available” without warranties of any kind, express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.
13. Indemnification
You agree to indemnify and hold harmless PressTitan, its officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of our Services, your content, or your violation of these Terms.
14. Changes to These Terms
We reserve the right to update or modify these Terms at any time. Changes will be posted to this page, and continued use of our Services constitutes acceptance of the updated Terms. We encourage you to review this document periodically.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising under these Terms shall be resolved exclusively in the courts of proper jurisdiction in the Philippines.
